Legal Question in Sexual Harassment in Virginia

Homeowners' Association

I am a Board member of my association. There is little or no participation by the homeowners; in fact we cannot get enough volunteers to fill all seats on the board. There are 100+ properties covered in the association. There is some consideration to dissolve the association. The by-laws state two conflicting statements: 1) association can be dissolved by a 2/3 affirmative vote of all homeowners and 2) association must be maintained for 30 years.

I believe the 30 year requirement is a legacy from when the property was organized as a condomimium. Weare definitely not a condo and hold only the entry way wall as a common element.

Can we dissolve if this is the mandate from the community?
