Legal Question in Traffic Law in Virginia

46.2-862 Reckless Driving 85/70 on I-66 in Fauquier County 6/23/2012. 5:30 PM, weather: excellent, roadway: dry, traffic: light, purpose of the trip: attending music concert.

State Trooper was real young but was pleasant. I was totally respectful during the stop.

Mitigating factors. I am 55, male, 100% clean driving and criminal record. I was driving a 2013 sports car I had recently purchased. At the time of the stop I had driven it less than 300 miles and I was not fully accustomed to the car.

I am out of state. The drive to the hearing is 2 hours. My goal is to have the ticket reduced to Improper Driving and pay the fine.

My wife is a WV paralegal so I do have the advantage of her know how but she is limited not fully understanding VA traffic law.

My question is can I do this over the phone or do I have to appear at the hearing to talk in person to the Commonwealth Attorney? Any idea of the fine for Improper Driving?

You or your lawyer should appear at the scheduled hearing to have a reasonable

chance of having the charge reduced to improper driving which is

merely a traffic infraction rather than a criminal misdemeanor offense and

which likely would carry only a minimal fine + court costs.
