Legal Question in Traffic Law in Virginia

My 17 yr old son got his first speeding ticket on the interstate. He was going 76 in a 55. Will the Judge automatically charge him or will he be given a change to take a driving class to reduce the speed limit? Does it automatically go to the insurance company? Thanks

If your son was charged with reckless driving(more than 20mph posted speed), he should have a lawyer representing him in the J&DR;Court where presumably the matter will be prosecuted.(Reckless driving is a criminal misdemeanor in the Commonwealth and in no event should your son agree to plead guilty to this charge.)

The option of completing a driving class may be available to him to further reduce his sentence.

And, no, whatever disposition you son may receive from the court would not be sent to any insurance companies.

Your son may have been charged with a reckless driving or with a speeding violation. There is a difference between the two. There are ways to fight these types of charges in court. There are also classes available to help reduce a possible sentence. The court does not assign points regarding traffic convictions. But the DMV most likely will. This may affect your insurance rates.
