Legal Question in Traffic Law in Virginia

Agressive Drivers

I was traveling to work during morning rush hour on the Parkway. Traffic was heavy & moving at a snails pace. An aggressive driver in the right lane decided the left lane was moving faster than hers and jumped out in front of me causing me to slam on my breaks. (10 mph)When the aggressive driver cut me off she did not signal or make sure that there was adequate room in front/behind her to change lanes. She did an unsafe lane change right? I slammed on my breaks and hit the bumper of her SUV. Our bumper heights are not the same level thus my car sustained the damage. And after phoning the officers for assistance, I got the citation for failure to maintain proper control. The aggressive driver who caused the accident gets off free. There were no witnesses that stopped and the officers did not review the scene or take note of my car and the location of my skid marks. Everyone left me there to fend for myself and wait for a tow truck. The aggressive driver was uncooperative and would not give me her info, and after asking the police for her info stating she refused to give it to me, they did not give it to me either. Are there laws that protect me from personal injury aggressive drivers cause? Help

Re: Agressive Drivers

Whether the driver pulled out onto your lane is a question of fact to be decided by potentially two judges. You face a criminal (i.e., traffic charge) and a civil complaint that is likely to be resolved through subrogation with the respective insurers. Your question is based on Virginia law as I am a Maryland attorney so I cannot assist you with these matters.
