Legal Question in Traffic Law in Virginia

Appealing Speeding Tickets

I am appealing a speeding ticket and I need some help. One morning on my way to work I was stopped by the police. My first issue is the police almost hit my car.He was facing me on the high way and when he was trying to pull out I was right out. So once he pulls me over he asks If I knew the speed and I said ''yes its 45mph.'' Then he asks me do I know how much I was doing '' yes I was coasting 50 to 55 the whole way. Then he says well I got you doing 65mph and I said agian I know I was doing 50 to 55 mph the whole way can you show me the radar? He's no. And start asking me other questions I was very coorapative. In court that day this particular officer had so many people that he had to go last the judge the was there didnt not even listen to my case he just sentenced me. Because I was the last to leave after comes to find out they are the best of friends. I have no problem with accepting my conseqeunce but in this situation I dont think that ws the case. 1. He almost hit my car. So now we are talking about a police that is driving reckless. 2. He could not provide me with proof that I was doing 65mph after I asked. 3. When we were in court and he lied he said in front of the judge that I arged to go 65mph.Help please.

Re: Appealing Speeding Tickets

You have 10 days from the date you were convicted in the general district traffic court

to file your request for an appeal and a trial de novo in the circuit court.

Unfortunately, based upon your description of matters thus far, I would not be terribly sanguine about the outcome of your appeal in the circuit court.

Re: Appealing Speeding Tickets

No requirement exists compelling police officers to show you their radar readings. Moreover, the manner in which the officer was driving has no bearing on the speed at which you were allegedly travelling.
