Legal Question in Traffic Law in Virginia
In an attempt to move over for a car that was too close to me I side swiped a mail box. When I stopped to make an assessment of the damages (which there was none to the mail box) only to my car to my car, I realized that the mail box is protruding many inches past the curb into the street. Would I be eligible for the cost of damages to my car from the owner of the mailbox?
1 Answer from Attorneys
Possibly, if you can prove that the owner of this mailbox erected/maintained it in violation of local zoning regulations,VDOT rules, or other applicable
requirements and which you could further prove by a preponderance of the evidence was the proximate cause of the damages which your vehicle incurred from this accident (my opinion).
