Legal Question in Traffic Law in Virginia

Auto Accident/Victim Injury

I was at fault for an auto accident in which both parties (both me and the victim) stated to the responding officer that we were uninjured, so no EMT was called. While the officer was filling out the accident report in his car, the fire department passed by and asked if everyone was okay. We all replied that we were, so they did not stop.

Now my insurance company is telling me that the victim in the crash reports being injured.

I understand that muscle stiffness takes a day or two to settle in, but what are the limitations on my responsibility in the situation? (This has already been filed with my insurance company, with whom I have full coverage, including personal injury and liability.)

Also, what is the likelihood that I would be sued beyond the limits of my insurance?

(The accident occurred when I rearended a car that was stopped, and I was traveling between 30 and 40 mph on a suburban road with a speed limit of 45mph.)

Re: Auto Accident/Victim Injury

Hard to say for sure, but your auto insurance policy limits will likely cover whatever claims that the one with the apparently delayed injury symptoms may make under the circumstances described.
