Legal Question in Traffic Law in Virginia
backed into an illegally parked car
At about 8pm at night, we backed our Chevy Tahoe straight out of our parking space in front of--name removed--townhome. Another car,--name removed--Honda Civic, was illegally (parallel) parked behind us, in--name removed--no parking zone. We did not see the car in our path and accidentally backed into it creating damage to the driver-side fender. It was dark, the Civic is black and it was illegally parked. The Civic obstructed our ability to back-up. Who is at fault? Who is responsible for damages to the Civic?
