Legal Question in Traffic Law in Virginia

blinking signal lights and an accident

My family and I were traveling N on a road, approaching a yellow flashing light. The W to E bound lane was a flashing red light. When we entered the intersection a white car appeared crossing on the W to E bound lane across our lane. The other driver was sited for failure to yield and explained to how to address an intersection, waiting until all traffic is clear to cross. Our vehicle is totaled and now the other drivers insurance is questioning thier liability? Me and my children all susatined injuries and went to hospital via ambulance. My husband was seen later that night. One of my children have a folow up apt. Both vehicles were towed per the police department. Since the other driver was sited and has a standing court date shouldn't they be liable?

Re: blinking signal lights and an accident

Yes, but you had better get a lawyer to represent you if you expect the other driver's insurance carrier to pay up whatever damages may be reasonably owed to you as a result of their client and policy holder's apparent negligence.
