Legal Question in Traffic Law in Virginia
My boyfriend received a reckless driving ticket doing 66 in a 45 in Virginia. The speed limit in that area goes from 60 to 45. He thought it was still 60 mph. Is there any way we can plead not guilty in court and get it lowered from reckless to just a 6 mph over the speed limit ticket?
1 Answer from Attorneys
The defendant should seek to speak with the prosecutor assigned to his case before court
begins on the day scheduled for his hearing.and make his case to this person for a reduction in the
reckless driving charge to one involving a speed infraction.
However, if the prosecutor refuses your boyfriend's overture for a reduction in the
charge, he should then consider requesting a continuance in the case to allow
for additional time for him to retain the services of an attorney to represent him
in this criminal misdemeanor matter,
