car accident, who is at fault?
I was recently in an accident, where after checking my mirrors and seeing that the car behind me was at a safe distance, started switching lanes. I was already starting to switch, when the car behing me sped up and tried going around me as i switched, and she hit my left front quarter with her right wheel area after trying to go around me. she then got out the car and said I had gotten into the outer lane after turning and hit her, but the turn was a good 40ft behind us! she hadn't even gotten to the intersection when I turned into the road. We also have the same insurance companies. There was another car that pulled over with us that was with her, because they seemed to know each other and spoke the same language, coul they claim them as a witness? there was also no police report. whose fault would it be? anything else I shoul know? Apparently, another she said vs. he said situation.
And, yes, the driver in the third car could potentially be a witness for the "she said version of the facts" related to the accident.
