Legal Question in Traffic Law in Virginia
County Fines for driving on revoked/suspended license
In 2001 while serving on active duty I was fined $2000 in absentia for a traffice offense, because I was stationed and living in California. I found out of the fine when i went to renew my license in California. I called Fairfax County General District Ct. and set up a payment plan. I was paying until one month my check was returned by the court in the mail. I called and was no more debt under my name or case, and I called DMV and VA dept of taxation and was told the same. I moved to Germany, and 5 years later I returned and my employer notified Fairfax County General District Court wants to Garnish my wages for the fine that I told was complete, with 800 dollars of interest added. I was also told my license has been suspeneded since 2001, but since then I've been able to renew my license and register vehicles with DMV. When I spoke with the court, they also told me its not their fault that I was given bad information and I'm still responsible for the fine. I never tried to escape the fine, but I took the proper steps considering my locations, and military commitments. I was also told the Soldiers and Sailors Relief Act will not protect me from my the interest that the account has gained. I would like some advice please !

Re: County Fines for driving on revoked/suspended license
It would appear that you need to take steps to establish what exactly you have paid the traffic court for the fine and present this record to the clerk's office so that an appropriate adjustment can be made(including any interest).
If they refuse to make your requested adjustments, then you may need to have a hearing before one of the traffic court judges on the matter.
FYI, the Soldiers and Sailors Relief Act was amended back in the 1990's to the Servicemembers Civil Relief Act(or something similar).
