Legal Question in Traffic Law in Virginia
I was driving around 57 mph in a 55 mph zone on a two lane two way road and an off duty police officer pulled out in front of me. He stopped accelerating at 43-45 mph. I drove about a carlength behind him for a quarter mile until i made it to the next passing zone and passed him. about ten minutes later in the parking lot of the gas station i stopped at a state police officer blocked my car in and took my information stating that the officer i passed is in the process of issuing a warrant on me for following too closely. i do not believe i was following too closely at all considering the roadway was dry, he was driving 10 mph under the speed limit, and i am only 20 years old so my eyesight and reaction times are quite sharp. Is there any way i can get this ticket reduced or dismissed as i cannot afford for my insurance rates to go up any higher than they already are. My driving record is clean except for a driving while suspended ticket back when i was 17.
1 Answer from Attorneys
The ticket you've described is unlikely to be dismissed. However, if you retain the services of an attorney to represent you who practices in the traffic court handling the matter, you might get the charge reduced.
