Legal Question in Traffic Law in Virginia

Driving on Revoked Licence

I had pulled into a cafe parking lot.Just as I got off my Harley I saw a cop pulling in behind me.He reminded me that tags were expired and asked for my licence. After running my name he told me that my licence was revoked (which I was not aware of) and placed me under arrest. I was site-released w/2 tickets.I am on probation (nothing driving related)and would like to know, when I go to court will I be facing jail time? If so, how much?

Re: Driving on Revoked Licence

Driving While Suspended(DWS)in the Commonwealth is a class 2 misdemeanor offense. The penalty for

such offenses is confinement in the local jail for up to six months and a fine of up to $1000; either or both.

First time offenders rarely have to serve any jail time, and whether or not you received actual notice of the suspension normally will be a consideration as to what sentence is actually imposed.
