Legal Question in Traffic Law in Virginia
driving while revoked
I was recently charged with driving on a revoked license for dui. However, the officer never actually seen me driving, nor did he ever pull me over. He stopped me when I was walking away from my vehicle and he arrested me. Is this legal?

Yes, quite probably so, since all the officer needs is probable cause for the arrest. Proving the case in court
against you, however, will be more difficult since the prosecutor will be required to prove the charge against you beyond reasonable doubt.
