Legal Question in Traffic Law in Virginia

driving with suspended license

I had a suspended license but i was not aware of it. the driving license was suspended for failure to pay reinstatment fees to DMV for an infraction that hapenned 2 years ago.i actually paid the fine 3 weeks after the infraction happened. the payment was made but was considered late (about 3 weeks), that triggred a DMV suspension notice that was sent to me by mail. At the time I did not intercept/was unaware of the DMV suspension notice and since I paid my fine i moved on assuming that I still had the right to drive. when i got pulled of, the officier informed me that i was driving with a suspended license. I have a court citation, will they understand the fact that I was unware of my suspended status? Thanks

Re: driving with suspended license

Yes, they(meaning the court)will, but you should explain it all first to the prosecutor assigned to your case before court begins on the morning of your scheduled hearing and determine whether he or she will allow you to plead to a lesser offense such as NVOL(No Valid Operator's License)since you apparently did not have proper notice of the suspension.
