Legal Question in Traffic Law in Virginia

driving on suspended license with out knowing

Not at fault in a traffic accident where someone turning left did not yield to me going straight through a traffic light. Police then said my license is suspended and made me sign a paper stating that now I know that my license is suspended. My car may be totaled, I cracked my patella, I have a wrist injury and chipped my teeth. Am I at fault due to the suspension of my license?

Re: driving on suspended license with out knowing

Notice is a required element of the charge of Driving on Suspended License. I regularly get this charge dismissed for lack of notice. If you told the officer you did not know your license was suspended, you may be able to get the charge nolle prosequi. You can then pursue your civil claim for personal injury.
