Driving with a Suspended License

While I was at the park with my kids, a police officer approached my friends and asked who was driving my white car. They came and got me, I told the police I was driving the car. There was a complaint from a citizen;I had to many people in my car. She asked to see my driver license, and I showed it to her. She looked it up and found out it was suspended, I had payed a previous fine earlier thru the city, and I thought it was taken care of. I didn't check with the DMV to make sure everything was o.k. She told me, my license were suspended. I didn't know. She proceeded to give me fine for Suspended licenses and I had no insurance.

If I wasn't driving the car when she approached me, is it legal for her to give me a ticket? What will happen when I go to court?

Yes, it was legal for the officer to issue you a summons for the jailable offense of "Driving While Suspended" under the circumstances which you've described, and you'll most likely be convicted of this offense as well as your failure to maintain the insurance coverage required under state law when you have to face the judge.
