Depends upon how soon the second conviction occurred after the first one.
If within five years, mandatory 20 days in jail and a mandatory minimum $500 fine. Va. Code Sec. 18.2-270B 1.
If between five and ten years after the first conviction, mandatory 10 days in jail and mandatory minimum $500 fine. Va. Code Sec. 18.2--270B 2.
If within 10 years of the first conviction, mandatory 10 to 20 days in the slammer, depending upon the BAC level of defendant and mandatory minimum $500 fine. Va. Code Sec. 18.2-270B 3.
