Legal Question in Traffic Law in Virginia
Expired 30-day Tags
I recieved a ticket for driving w/expired 30-day tags. I was driving in my apt complex, the officer claimed to have seen my vehicle come into the complex earlier that day off of the public road. Is it illegal to drive w/in my complex w/expired 30-day tags? Can an officer give me a ticket for something he claimed to see earlier that day? What is the definition of a public street/road? Thank-you

Re: Expired 30-day Tags
The definition of a public street or road is not necessarily easy to come by. However, the officer by his own admission apparently did not write you the ticket for driving on the grounds
of your apartment complex but rather for his claimed recollection of your operating the vehicle at some earlier time in the day on a public road leading to the apartment complex.
Therefore, it will be your word against the officer's when the case is heard in traffic court. Any witnesses you can bring with you to court who can buttress your side of matters by testifying truthfully that to the best of their knowledge you never drove out of the complex on the day in question could mean the difference between your winning or losing.
