Fail To Yield the Right of Way
I was driving home from work and the speed limit was 50 mph. I was going about 55mph and this Buick came out of McDonald's and hit me in the side causing me to spin into a gas station. I avoided the pumps and the store, only because of a parked car which my car smashed into. The driver that hit me says I was going 80mph,which is a lie. I injured my neck and back in the accident. Who's liable in this situation me or the driver who hit me?

If the other driver's insurance company takes their client's word and deny's your claim, then

you're looking at a trial in the general district court to decide the issue of liability.

It is not too soon to start now to prepare for that likely eventuality by securing the names of witnesses, their addresses, and phone numbers,

and taking other measures, like retaining a competent attorney to represent you.
