Legal Question in Traffic Law in Virginia
My father recently received a "United States District Court Violation Notice". The charge: "Possessing more than one driver's license at any one time". As a short summary, he works in Bethesda, MD as an electrician (for a company, not self-employed). The work site was located within a military base, in which they (the guards) asked my father for ID. Naturally, he provided them with his CURRENT VA Driver's License. However, he still had the EXPIRED driver's license underneath (never removed from wallet). Note: These ID's are legit (VA DMV issued, and containing identical information except for the expiration date, of course), not falsified ones other people use. It's simply that my father never removed it from his wallet. However, he is now charged with this violation, and a $520 fine! It seems to me that this charge would suit an individual having multiple ID's from other States, different ID numbers, different aliases, etc. Not for the simple fact of carrying a legitimate, authentic, expired license that would not be accepted anywhere anyway! Please provide us with legal advice as to this unique situation. Thank you-Vic

Your father's defense should obviously be that he only had in his
possession at the time of this incident one VALID driver's license. (It is
not unusual for a person to also still be still carrying in his or her wallet
or purse the one which previously expired which cannot be a violation of the offense cited nor any other law.)
