Can I fight a ticket for parking in a handicap space with good reason?

Ok my fiance got a $250 parking ticket for parking in a handicap space which I understand and we are both usually against, but here is the story. She got off work at 3 A.M. in the middle of the night. It was right in front of her apartment building and like always there wasn't one, and I mean one, parking space in the entire complex. She had no other option to get to her home but to park there. Can the apartment complex be at fault at all because of no parking? Is there any defense anywhere in this scenario or ever?

Yes, your friend should appeal(using the reasons mentioned as mitigating factors) the matter with the local parking enforcement agency, and, if necessary, from there to the general district traffic court.
