Legal Question in Traffic Law in Virginia

Who is at flaut?

I was at a stop sign trying to cross onto the other side. My way was clear.I crossed over and was ready to go into the lane. When a car hit my left back(aksole)wheel and put a dent in the car.I could not drive the car home and I had to get it towed home. The police officer give me a ticket for Fail to yied right away. What are my chances in winning the case. The lady had to been driven fast to cause damages to my car. How can I argue that I'm in the right and she was wrong. Court is next month.

Re: Who is at flaut?

Trying to cross to another lane after you had already reached the stop sign was a maneuver obviously more risky that you realized.

You contend: "My way was clear". The facts would suggest it was not. Furthermore, merely because

the other vehicle put a dent in your vehicle doesn't necessarily mean "the lady had been driven fast". Substantial damage(as TV crash tests show) can be caused to vehicles going a mere 5 mph.

One key piece of information is missing from your inquiry. You give no indication whether the other driver received a ticket also. If not and the officer who arrived on the scene determined that she did nothing wrong, I give you around a zero chance of winning your case.
