Legal Question in Traffic Law in Virginia

Should I hire a lawyer?

Good afternoon,

I received my first reckless driving ticket in May 25 because I was doing 80 on a 55 at interstate 95-S. I obtained my MVR from the DMV two days ago and my driver point balance is -7. I got my first ticket, 46.2-875, back in January 2005 and I was forced by the DMV to take a driver improvement course. My second ticket was for regular speeding, 46.2-870, in November 2005; and the last one was given to me because I did not see a stop sign, 46.2-821, back in November 2006. I received all of my tickets in Fairfax County (what a coincidence) and I have to go to court in two weeks. I am not sure if it is necessary to hire a lawyer, but I understand that declaring myself guilty will be considered as a misdemeanor 1 and will go to my criminal record. I am trying to plea guilty to a less severe charge as improper driving. I do not know if this helps, but I am 20 years old and have a clean criminal record. Will a lawyer help me in order to achieve my goal? I would greatly appreciate your assistance.

Regards,

Jonathan

Re: Should I hire a lawyer?

Yes, a lawyer may be useful in negotiating a plea bargain for you involving a less serious offense such as a speeding infraction, although Improper Driving is much less probable.

You will want to avoid a conviction for reckless driving which is a Class 1 misdemenaor (and a crime) at all costs.
