Legal Question in Traffic Law in Virginia
I was hit by a tractor trailer. My car is totaled per my insurance. I was not at fault in the accident. Did not recieve a ticket and I do not know if the truck driver did. I do not have any injury just stiff and sore. I went to er next day and was checked out every thing okay. My insurance company has advised that they will pay me 5000.00 for my car. 2008 ford focus with 23700 miles. My question is can I take the trucking company to court and recieve more money? I do not want to buy another car and the accident was not my fault. My colision center told me that in order to fix my car it would cost 7000.00. All I want is to have my car fixed.

Yes, you should be able to sue the trucking company as well as the driver of the truck who apparently was responsible for this accident.
