Legal Question in Traffic Law in Virginia

I was in the right lane of a three lane rd (middle was turning lane for both ways). Several cars were parked in the right lane waiting for kids in a school to get out. In order to get around the parked cars, the flow of traffic was to enter the middle turning lane and then get back into the right lane after the parked cars. Someone pulled out of a driveway in front of the parked cars and t-boned my car in the rear panel (I did honk and swerved to avoid him). The opther insurance company is refusing to pay because they say I was in the middle lane illegally. I say we had no choice due to the parked cars and it is legal to drive in that lane for 150 feet per VA law. What do you think?
