Legal Question in Traffic Law in Virginia
Legal Liability for Separated Spouse without Auto Insurance
My wife and I have been formally separated and living apart for 6 years. We are in the process of obtaining a divorce. It has just come to my attention that she does not have automobile insurance on herself or our 17 year old daughter who she has custody of. If either would be involved in a traffic accident would I be legally responsible in any way? And is there any way she can be forced to obtain car insurance?

Re: Legal Liability for Separated Spouse without Auto Insurance
You should have a PSA(Property Settlement Agreement)concluded to settle all such issues
regarding financial liability of the spouses as well as insurance coverage for the minor child.
The PSA can then be incorporated into and will be part of your final decree of divorce.
