Legal Question in Traffic Law in Virginia

Any legal term for this?

This isn't really ex post de facto but I'm trying to figure out what it is.

Suppose cops were to warn you that you are about to get your parking privlages revoked because you were parking without a decal, and it in parking policy it states that they will warn you after 4 violations. Let's say they warn you after 6 violations. In the policy it also states that after you have been warned, if you are in violation again, they can take your privlages away from you completely. So you get another violation and they take your privlages. Since they didn't follow the rules on when to warn you about it (warned you later than they should have) shouldn't this render the whole process obsolete. Is there a term for this?
