Legal Question in Traffic Law in Virginia
My licence was expired and, hit by drunk driver
I did not know my lience expired, till after 3 days of the crash caused by a drunk driver. I receved a letter in mail from Police department, driving with out licence. Went right on line and renewd it. It expired 8-3-07 and the crash happend 8-26-07 less that 30 days. I had lost my prev. licence it did not expire till 8-31-07, I was given a dup copy yet the changed the expiration to 8-3-07. I have current lience as of 8-29-07. I have an Attorney. Will the drunk driver get off free of my injuries and totaled vehicle?

Re: My licence was expired and, hit by drunk driver
No, that's not too likely, unless the
allegedly inebriated motorist is able to show that you somehow negligently contributed to causing the accident.
The fact that you may not have technically had a current license at the time of the accident should not suffice as a basis for such a showing.
