Legal Question in Traffic Law in Virginia
I live in the state of Virginia and my brother just moved down here from Delaware and lives with me at my house. He is a convicted felon with a suspended (conditional) driver's license in the state of Delaware. A couple of weeks ago, he came down here for job interviews and to work for 2 weeks in an attempt to a fresh start. During his travel back home to DE, he was pulled over in MD for what I would consider profiling or stereotyping. The officer stated that he was pulled over simply because he looked suspicious and that there is drug trafficking between VA and DE. His vehicle was searched and nothing was found. At this time, the officer found out that his driver's license was suspended (until Oct. of this year through the state of DE). The officer wrote him a ticket and let him go stating that he needed to appear in court in approx 3 months - or when he was notified by mail. I helped him move here (VA) this past weekend and he has notified the courts in MD that he's moved. He is also in contact with a public defender in MD. I've read that there is a chance of jailtime and fines, but since he's from out of state with an out of state suspended license, he would like to pay the fine and be done with it. He's obtained a job and is willing to go through defensive driving courses, etc.
Is there any advice you can give that could help us in not having him serve any time is jail?

It is unlikely that your brother will serve any jail time for this offense, if this is his first such offense in Maryland. (Completing the defensive driving course before the scheduled court hearing would probably be a plus in his favor.)
