Legal Question in Traffic Law in Virginia

Paced speeding ticket - first offense

The ticket says 70/55 as the violation

under ''clear'' conditions and the

method used was pacing.

I know I was going no more than 63.

I have contacted the officer in hopes

of meeting with him to find out

exactly where he claims I was going

this fast as he would only respond

''back there'' when I was pulled over.

So far, my request has not been

replied to.

I have maps of the rolling terrain and

slow curves on the 4 lane highway.

In addition I have surveyed, taken

video, and done some calculations

which prove I wasn't going 70 and

promote my theory the ''about 70''

he told me was roughly his catch up

speed.

I intend to argue that based on my

account (and his which will mirror

mine in the order of events) the

officer could not have paced me

accurately at that speed. To add to

my argument that he was

incompetent (not the wording that

will be used), he cited the location of

violation incorrectly, a location that

doesn't exist.

Also, I have acquired my driving

record from the DMV, so that when

that unfortunately inevitable ''guilty''

comes around, I can hopefully reduce

the sentence.

Re: Paced speeding ticket - first offense

So, your question concerning this matter is what; should you put on a defense?

Of course, but have that DMV record handy.
