Legal Question in Traffic Law in Virginia
When parking on our cul de sac, a driver parked halfway across our driveway. There were many other places where this person could have parked.
Not expecting our driveway to be blocked, my husband backed out our car from our garage and hit the right rear section of the other car. That car suffered a broken plastic rear light cover and some small scratches. Our car had lesser damage. Are we in any way responsible?
Is it not illegal to block a residential driveway?
1 Answer from Attorneys
Yes, it's illegal to block a residential driveway, but it's still possible that your husband could be
considered legally negligent depending upon what he did or didn't do as he was backing
up and therefore might well be considered to share in responsibility for the resulting damage to the two vehicles.
