Legal Question in Traffic Law in Virginia

Parking Lot Door Ding

When we returned to our car in a school parking lot, a person accused my teenage daughter of having opened her car door into her car. She claimed that the door ding wasn't there when she parked and is there now. When I looked at it, there was no dent (she concurred at the time) and it looked to me like paint was scraped on her car, not off it. The scrape was about 1.5 inches high by 1/8 inch long. I opened my door and while it did line up, my door only came close to touching her door. It did not touch. My daughter said that she had not done it. At the lady's request, I gave her my name and phone number. She called me with an estimate for $500! Apparently, now there is a large dent. Also, she is claiming the paint was scraped off her car which was not the case. There is no green paint from her car on my tan car. She wants the $500. I don't even believe that we did it. Does she have a case because I was stupid enough to give her my contact information never believing I was guilty? I also never assumed to be robbed by an opportunist. There are no witnesses either way other than my daughter who maintains there is no way she did it. I had arrived seperately in another car and we were switching back cars when confronted

Re: Parking Lot Door Ding

Why should "she have a case", if by that you mean a viable case with a credible factual predicate, as certain counsel are wont to say, which might well persuade a trier of fact hearing the matter. I don't think so.

Tell her that based upon the original facts regarding this case as you(as well as your daughter) know them compared to this new array of facts which has recently emerged with her claim for $500 for repair and which are disturbingly inconsistent with these original facts, that you must refuse her claim.
