Legal Question in Traffic Law in Virginia

I was pulled over on a moped in virginia beach virginia, and issued a ticket for driving while revoked, Va law claims "although you do not need a driver's license to operate a moped, you may not operate a moped if you have been declared a habitual offender or your license is suspended or revoked for driving under the influence of alcohol or drugs". My license was suspended for possession but thats automatic in Va, and i was not charged with dui/dwi. Also anything under 50cc is not required to be registered as a motorcycle, my scooter is 49.5 :)...with no modifications, 100% stock. My question is, is it just me or does this driving while revoked sound bogus? i mean theres no way this will stick right?
