Legal Question in Traffic Law in Virginia

radar and speeding

I received a speeding ticket in VA as well as my brother-in-law on the same day. I was following him and I was about 8 car lanes behind. The left lane was ending so we sped up to get to the right lane since a truck blocked his way and I had cars to my right slowing down. My brother-in-law passed the cop first and I passed the cop while the cop was pulling out. The cop said he clocked us both at 95 in a 65 then gave us the citations. We went to court and the judge didn't want to hear anything and gave us both a 1500 dollar fine a 6 month suspension. We both obviously appealed it and I want to know now what we can do to fight this since we didn't have a fair trail in the begining. I positively know that I was not doing 95 since I 1)had my son in the car and 2)I had to slow down since the cop was pulling out. So I don't know how I was charged that velocity.

Re: radar and speeding

The lawyer whom you are going to hire to represent you in this matter now on appeal up in the circuit court, will be the one to whom you should address these questions.

And, no, I would not, if I were you, try to handle this on your own.

You will have to file an appeal in that state immediately because there is usually a time limit for filing an appeal. If you do not file an appeal there New Jersey will probably give recipocity and suspend you license in New Jersey.
