Legal Question in Traffic Law in Virginia
i was recently charged with reckless driving in Virginia. I am from Pennsylvania, how much is a reckless driving fine in Virginia and would the points be transferred over to Pennsylvania?

Reckless driving is a criminal class 1 misdemeanor. This means the potential maximum punishment is 12 months in jail and/or a $2500 fine. This is in addition to the fact that you would have a criminal conviction. The points are assessed by DMV and /or your insurance company, not the courts. You would receive 3 or more demerit points in Virginia and that would be reported to Pennsylvania. They would in turn report that to your insurance when asked. You may wish to consult an attorney, such as myself, about what you can do to reduce these impacts.
Under no circumstances should you plead guilty to a charge of reckless
driving in Virginia. You may be able to get it reduced to the relatively minor
traffic infraction of Improper Driving if you discuss the matter before court begins with the prosecutor assigned to your case and have some sufficiently persuasive mitigating circumstances involved to convince him or
her that this would be an appropraite disposition of the matter.
(See Va. Code Sec. 46.2-869.)
I agree with prior attorney remarks. Reckless can be negotiated or won. Attorney Sheryl Shane. Tel. 703 503 4448. Web: www.sherylshanelaw.com.
