Legal Question in Traffic Law in Virginia
Reckless Driving Charge
Several weeks ago I was involved in an auto accident in which my vehicle flipped. A week after the accident, I recieved a phone call from a state police trooper who informed me that I was being charged with reckless driving. However, I recieved no citation, summons, or ticket at the scene or in the hospital while I was there. I am an out-of-state resident in the military, and now the office wants me to travel to VA to accept the ticket and whatnot. Am I under any obligation to go? Did the officer fail to do his job? What are my options? Thank you.

Re: Reckless Driving Charge
I certainly would not travel anywhere to pick up a ticket, summons, or whatever which should have been issued to me(if appropriate)at the scene of the incident so that I could be formally charged with a criminal offense.
However, if at some later time, you receive an official notice to appear from a Virginia traffic court on the reckless charge, you will need to appear on the date and time specified and, much preferably, with counsel.
