Legal Question in Traffic Law in Virginia

Reckless Driving 46.2.862

I received a reckless driving ticket on 04/30/2004 as I was

returning home on 267 West Toll road. I was issued citation

under 46.2.862 speeding 77 MPH in 55 MPH zone.

I am really worried about VA law that states that Reckless Driving is Class 1 misdeamenor and would have effect on future security clearances and Job background serach. I was not recklessly driving and I am not sure that I was driving at 77 MPH, may be around 71-72 MPH. I would like to make sure that I do not get this on my record. I have one ticket before for driving 75 in 65 MPH highway in PA issued in November 2002. My point balance is -2.

What are my options.

There are around 15 or so different kinds of reckless driving recognized in the Virginia Traffic Code. Each is categorized as a Class I

misdemeanor, as you've already noted with respect to the particular version of this offense with which you've been charged. And since Class 1 misdemeanors are jailable offenses, you should have a competent defense counsel to represent you in this matter.

If you cannot afford to hire one, you can ask that the court appoint one to represent you.
