Reckless driving

My vehicle was hit and totaled by another vehicle. The other driver was ticketed for this accident. I only had liability on my car as it was paid off. The other vehicle was a commercial vehicle, their insurance company has contacted me, but has yet to see my car. Although both were towed to the same lot, their vehicle has been removed, probably to be repaired. I've been told by those who have seen it that it should be considered a total loss, therefore, I can expect blue book value. Can I take the driver to court? Blue book value will not be enough to buy a comparable car.

Yes, you can sue the other driver as well as his employer(assuming that the driver was on the job when the accident occurred). Their insurance carrier will then send in lawyers to represent them.

However, by the time you factor in the likely costs associated with the litigation, you are unlikely to recover much more than the blue book value of the vehicle.(And maybe not even that.)
