Reckless Driving-General

I am currently 21 years old.I have been licensed for 4 years and my point bal. is -17 (terrible, I understand).My last ticket was a minor ''Fail to obey highway lane markings'' on 06-03-08,convicted on 07-10-08,so I have been staying ''clean'' for 9 months now.Yesterday, 03-17-09 @ 10pm,I spun out and hit the guardrail on Oldbridge Road approx. half a mile from Route 123.No severe damage to the vehicle,only a scrape across the front bumper (very minor).A Prince William police officer witnessed the collision and immediately pulled me over.I provided my valid DL and registration and cooperated 100%.I admitted that I had 1 beer at Brittany's Bar and traveling too fast for the sharp curves on Old Bridge.I also admitted I was not looking at my speedometer to know exactly the speed I was traveling.I passed all the sobriety tests I was given easily with no faults and once given the breathalyzer that is ''not going to be used in court'' I blew a 0.026,confirming my truth to the officers.Officer summoned me for 46.2-852 (Reckless Driving-General Rule) and said he can't charge me for speeding since he didn't have his radar.I have taken the safe driver course for 5 pts earlier this year already.With an attorney,what is my possible outcome? Thanks!

Seems to me with the right counsel you might be a candidate for a reduction in the reckless driving charge to that of improper driving, a mere traffic infraction under Va. Code Sec. 46.2-869.
