Legal Question in Traffic Law in Virginia
Reckless Speeding ticket
I received a summons to appear in court for doing 88 mph in a 65mph zone. Can I just pay a fine and receive the points because I live out of state. Will I have to do jail time? I have 3 kids to take care of.

No I'm afraid you cannot prepay your fine if you were charged with reckless driving. You will have to appear in court if the charge is reckless driving. If its just speeding, however, it may be possible for you to prepay. Just review the ticket and you will see what you are obligated to do.
Re: Reckless Speeding ticket
No jail time, unless there is something on your record that you haven't told us. The Va. judges are pretty good about listening to explanations/excuses and the fines aren't that unreasonable. Just don't expect "I have 3 kids to take care of" to wash - if you have 3 kids to take care of, driving 90 mph is a good way to orphan them.
Re: Reckless Speeding ticket
Unless the ticket says on the front "court appearance required" you can just pay the ticket and get the 4 points. There would be no jail time. In the alternative, if you would like to try and get a reduced number of points, I could represent you in court in NJ without you even having to appear by your allowing me to represent you by affidavit. If this is something you would like to consider, please contact me. Thank you.
