Legal Question in Traffic Law in Virginia

Reduction of points in VA

I am a resident of NC and received a ticket in VA for doing 14 miles over the limit. I am concerned about points and my insurance. I have been told even if I go to court the points cannot be reduced. True?

Re: Reduction of points in VA

You would need to talk with a Virginia attorney in the County you got a ticket to see what the possible reductions and deals are. Then that same deal should carry over here. In other words, if you received a reduction to 9 miles over, then that would carry over to NC and you would not get insurance points if this was your only speeding ticket in the past three years. Similarly, if you got a non-moving violation in Virginia, then you shouldn't have any problems here either. I know from other people that got tickets in Virginia, that it may be possible to get a deal. Like here, it may depend on the County you got the ticket.

Re: Reduction of points in VA

To clarify, the court does not issue demerit points, and consequently can not "reduce" the number of points. Your state DMV assesses demerit points based on the grade of offense of which you are convicted. Speeding 10-14 in Virginia is 4 demerit points and stays on your record for 5 years. In comparison, reckless driving by speed is 6 points and remains for 11 years. If you have a clean driving record, an attorney should be able to obtain for you a dismissal with a driving school referral, or a reduction to 1-9 (3 point offense, 5 years) with no referral. It is also a matter that your attorney could handle for you without the necessity of you appearing in court, unless you wished to contest the charge and tesify on your behalf.

Re: Reduction of points in VA

It's my understanding that the Virginia DMV does allow a reduction in points on one's Virginia driving record if one attends a driver improvement program which, apparently, can now even be done online.

Whether the North Carolina DMV has a similar policy, I have no idea.
