Legal Question in Traffic Law in Virginia

school zone speeding ticket

I just recieved a ticket for doing 40 in a 25mph school zone.the regular speed limitis 35mph and the school zone sign was not flashing but i still recieved a ticket for this. is there a way to find out the time the speed limit is in affect ? and do i stand a chance trying to argue my case in court or should i just prepay the fine. i really feel that i wasnt in the wrong here because the sign was not flashing and no school children were even present

Re: school zone speeding ticket

The 25 mph speed limit should normally apply only when the school zone sign was flashing its lights. If the lights were not flashing when you drove through the zone, then the ticket was improperly issued and you should contest it in traffic court on the day your case is scheduled for a hearing.
