Legal Question in Traffic Law in Virginia

Situation is this my mothers car broke down in my driveway, she gave me the keys and advised to give them to the mechanic when he arrived. Now in the meantime she did not allow or give me nor my husband permission to drive her car. Me and my husband had an argument I left the house for a walk, moments later I looked behind me to see her jeep being driven by my husband coming up the road. Mind you my husband does not have a license, and my mom did not give him permission to drive mainly because of that reason. Now needless to say he flipped the jeep with our one year old in the car. More so flipped the jeep. The police refuses to press unauthorized use of motor vehicle on him, stating that it was negligence on my part of keeping the keys from him. My mom has a note she made my husband sign a year ago stating that he was not to operate the vehicle but we are still having issues with getting charges filed how can this be especially with a signed note and her point blank stating before she left that her car was not to be used by either one of us ?

Your local law enforcement authorities have apparently decided that what you've described properly involves civil claim(s) rather than criminal charges.

And, therefore, you shouldn't expect to see your errant husband criminally charged anytime soon (in my opinion).
