Legal Question in Traffic Law in Virginia
My son was in a car wreck in VA on saturday. four cars involved, he rear ended a van which his an SUV which hit a BMW. There is no way he caused all four cars to hit each other. The cop gave him a summons for tailgating even though he was 7 car lengths behind. They want him to show up for court during late September. Why did they give him a summons versus a ticket? Does he have to go to court or will they find him guilty and he pays a fine? Do the points (4) transfer to Pa?

Yes, your son will have to appear in court on the scheduled date most likely because the offense with which he's been charged is not payable before court as often is the case with a ticket offense.
Given what appears to be the considerable potential not only for
criminal but also civil liability as well for your son in this case, he would seem very ill-advised
to try to represent himself and without the services of an experienced traffic
counsel in this matter.
