Legal Question in Traffic Law in Virginia
Speeding ticket
I was cited for a speeding violation in the state of VA. I am of Asian ethnicity, however on the speeding ticket, the officer put my race as White. I'm obviously not a white person ( as anybody who sees me can attest) and I was wondering if I can use this in Traffic Court. My argument is: ''If I'm obviously non white and he wrote my race down as White and got it wrong, then is it also possible that he got my speed wrong? '' How can he miss that when he was standing two feet away at broad daylight? Will it fly or is this just a pipe dream?

Re: Speeding ticket
Just a pipe dream, I'm afraid. Chances are(altho you don't say) that you were caught on radar, which are
normally correctly calibrated to give accurate readings. The fact that the officer through a probable oversight misidentified your ethnicity on the
ticket would in no way call into question the
validity of the radar reading. Unless your're prepared to mount a technical challenge to the
operational integrity of the radar(assuming one was used), be prepared to pay up.
