Legal Question in Traffic Law in Virginia

Speeding Ticket 80 in 65 zone

I got a ticket in Virginia (I-81 near the Luray cavern area- it say the officer used a S-Radar. There were sevderal cars all going together. I had the misfortune of having a truck tailgating me big time and I moved over to the left to get away from the trucker. Just as I moved over I saw the cop behind the hill. I really don''t think I was going 80.

What can I do to fight the ticket?

Re: Speeding Ticket 80 in 65 zone

If you've been charged with reckless driving(80+ mph), a criminal and jailable offense, you should have an attorney representing you. However, if it's only a speeding ticket(an infraction), you should be able to handle it yourself without the aid of counsel.

Just get to court early on the day scheduled for your hearing and ask to discuss the matter with the prosecutor assigned to your case. Explain the circumstances to her or him, and offer to plead guilty to a reduced charge, perhaps, in the 70-74 mph range.

If your driving record is good, bring a copy of it to the hearing and be prepared to show it to the prosecutor at the appropriate time.
