Legal Question in Traffic Law in Virginia

Speeding Violation during a Restricted License term

I just got a speeding violation driving 74 in a 55 zone in Fairfax, VA jurisdiction but I have a less than stellar driving record that includes me currently driving under a restricted license term that is due to expire in just one month (1/23/2007). The ticket issued today displays a court date of 2/13/2007, so does this mean since this ticket's court date is held AFTER the date ending my current restriction period, would I need lawyer representation or do I just pay the fine as a normal ticket violation? Moreover, will this speeding violation have any consequence on my current restricted status? The restricted license was issued as a result of a DUI charge conviction on 1/23/2006, with a 30 day jail/29 suspended, $500 court fee/$250 suspended.

Re: Speeding Violation during a Restricted License term

A conviction for the pending violation should only have consequences for your restricted license status if such a conviction violates one or more of the conditions required for the issuance of the restricted license.

In any event you should endeavor to get the speeding charge reduced (perhaps by nine miles or so)in order to minimize any possible adverse impact which a conviction on this pending charge might have. A lawyer could obviously be of assistance in this matter and might well be worth the several hundred dollars it might cost you.
