if they did away with that law why are people being convicted of it

People are no longer being convicted under Va. Code
Sections 46.2-351-355 which was known as the habitual offender law repealed by the state legislature on July 1, 1999.
They are, however, being convicted under other statutes which punish serious repetitive conduct
involving the operation of a motor vehicle such as DUI as exemplified by Va. Code Sec. 18.2-271(C) or
18.2-36.1 and which impose penalties or sanctions
on those convicted similar to what may have been
imposed under the former now repealed habitual offender law.
